The LA County District Attorney’s office has asked the court to delay the deadline for its response to the petition until December 20, 2024.

The high-profile murder trial of the Menendez brothers has several moving parts, and one of the biggest decision-makers will be the incoming Los Angeles county district attorney, Nathan Hochman, who was a factor in Los Angeles Superior Court Judge Michael Jesic’s decision on Monday to delay the resentencing hearing.

A Los Angeles County judge on Monday postponed a hearing over the possible release of Lyle and Erik Menendez after 35 years in prison for the shotgun murder of their parents, saying he wanted to hear from a new district attorney taking office next week.

"Part of the problem with the Gascón timing of his decision is there's a cloud over that credibility," Hochman said. "Is it a just decision, or was it just a political ploy? There will be no cloud over whatever decision I do.
