Sergio Rodriguez's parents accuse the rail company as well as the person who operated the train of negligence and are seeking more than $1 million in damages.

HOUSTON, Texas (KTRK) -- A pedestrian was hit and killed, apparently by a Union Pacific train, on Monday morning, the Houston Fire Department told ABC13. It happened a little before 7:45 a.m. in the Pecan Park area, located just south of Harrisburg and not far from the Port of Houston. The scene also isn't far from Milby High School.

The mayor of Houston says the city will build a pedestrian bridge over Union Pacific tracks where a high school student was killed earlier this week, and wants the railroad to pay for at least some of the project.

"Children make mistakes. Do they deserve to pay for them with their life? " the family's attorney asked. The victim's parents are asking for changes in the train operation schedule and the construction of a pedestrian bridge.
